Aggression in the Workplace: The Subtle Art of Bullying
Overview:
In a survey of more that a thousand U.S. workers, 42% reported incidences of yelling and other kinds of verbal abuse in their workplaces, and almost 30% admitted to having yelled at a co-worker themselves. Aggression and bullying wreak havoc on workers, as demonstrated in studies where physiological responses were monitored during arguments. In the heat of the moment, the person being targeted becomes emotionally hijacked, particularly when the attack is from a boss whose opinion carries much more weight.

This program provides an overview of three key areas necessary for avoiding aggression in the workplace – communication, anger management, and mediation.

The Americans with Disabilities Act: Your Guide to Compliance
Overview:

Complaint Investigations - What Represents "Thorough"?
Overview:
An unlawful discrimination complaint may be filed by an individual described in one of the categories below:

A. Any employee of the company, including classified personnel, contract employees, customers and vendors as well as any applicant for employment, who believes that he or she has been discriminated against by the company, a branch of the company, or another member of the company on account of race, color, religion, national origin, sex, age, handicap, or Vietnam-era or disabled veteran status; or

B. Any person who believes that he or she has been threatened with or subjected to duress or retaliation by the company, a branch of the company, or a member of the company as a result of (1) opposing any unlawful discriminatory practice; (2) filing a complaint hereunder; (3) representing a Complainant hereunder; or (4) testifying, assisting, or participating in any manner in an investigation, proceeding, hearing, or lawsuit involving unlawful discrimination.

Handling a harassment complaint is difficult. How managers and supervisors deal with the alleged victim and the accused is critical to employee morale. How they handle a complaint can mean the difference between a lawsuit and an internal resolution to the situation.

This seminar emphasizes the importance of documentation, protecting the victim, and being sympathetic and accurate. It also stresses prevention as the best tool to help keep your employees minds on their jobs and your organization out of court. Every investigation process must include four elements. Discriminatory Practices: How Does Your Company Measure Up?
Overview:
This comprehensive training course is designed to provide human resources generalists, EEO/AA specialists, and attorneys with a practical understanding of the fundamental principles and requirements of the equal employment opportunity laws. The primary focus is on federal EEO laws, but participants are also exposed to some of the principles and requirements of state and local EEO laws, as well as the application of state common law to the employment area.

Effective Discipline and the Termination Process
Overview:
Employees need information and facts regarding their performance on the job, otherwise they won't be able to make behavior modifications and meet expectations. Employee termination is often the last step in an unsuccessful attempt to help a worker meet work standards. On those occasions where termination is necessary, it sometimes needs to be performed with consummate skill and sensitivity. Unfortunately many managers have no idea how to properly conduct a termination, and this lack of knowledge puts the manager and the employer at risk. Fair Credit Reporting Act: Facts and Fiction
Overview:
A recent Illinois case sheds new light on the importance of employee training and monitoring in regards to the use of credit reports. In the case Del Amora V. Metro Ford Sales and Serv. In., a company was held liable under the Fair Credit Reporting Act (FCRA) for an employee pulling a credit report for a non-permissible purpose. The court held that imposing vicarious liability under the FCRA was consistent with the intent of congress to protect consumers from improper use of credit reports. The 1996 amendments extend liability to "any person" who willfully or negligently fails to comply with the FCRA's requirements. The term person, in this case, is broadly defined to include corporations.

If you are a user of credit reports, it is valuable for you to establish a policy concerning the use, storage and disposal of such reports. It is not enough to merely establish the policy, you must set up employee training and monitoring to assure that it is followed.

Family Medical Leave Act: What You Should Know

Summary Plan Descriptions: Are You Meeting the Requirements?
Overview:
Most employee benefit plans maintained by private employers, including retirement and health and welfare plans, are governed by ERISA. ERISA establishes the standards designed to ensure employee benefit plans are created and maintained in a fair and financially sound manner. One of the requirements imposed by ERISA is that plan administrators provide participants and beneficiaries with a written summary plan description (SPD) describing the key benefits, obligations, terms, and conditions applicable to the plan in clear, easily understood language.

Plan administrators who fail to provide an adequate SPD to participants and beneficiaries are subject to possible civil and criminal penalties. Additionally, a company’s SPD is often an important exhibit in lawsuits between employees and the plan administrator. As a result, employers who administer ERISA covered benefit plans must take time to understand and comply with the SPD rules imposed by ERISA. ERISA requires employers/plan sponsors to provide specific types of communication within certain time frames.  During this seminar, we will discuss those specific types of communication and when you need to provide them to plan participants.

Overview:
Workplace violence is an important safety and health issue in today's world. National statistics show a continuing increase in the number of assaults and homicides in the workplace. An employer's obligation to address workplace violence is covered by the general duty clause of the Occupational Safety and Health Act (OSHA) and encourages all employers to develop workplace violence prevention programs.

Failure to prevent workplace violence has important legal consequences for employers, managers, and employees. Although you may feel that you are not at risk, it still makes sense to become informed and take some basic precautions. The seminar assists employers in recognizing and eliminating incidences and losses related to workplace violence.

Wrontful Termination - Are You Prepared? Are You Sure?
Overview: Some state laws support an "employment at will" doctrine, which maintains that both the employer and employee are free to terminate the employment relationship at any time and for any reason (as long as that reason is not illegal). Increasingly, however, the concept of employment at will has been eroded in the courts, and even companies located in so-called "at will" states have incurred liability when the circumstances of the termination suggested the fired employee was wronged in some way.

The laws concerning what constitutes wrongful discharge vary by state, but there are certain instances where termination will always be considered illegal. In addition, there are other variables that will have a bearing on whether a particular termination is appropriate, such as whether there is a written employment contract, the wording of any employment handbook or policy manual, and the prior actions and practices of the company. As a result, it's essential to adopt sound termination practices no matter where your business is located. This seminar will discuss the elements required for every termination process.

  • Conducting the termination responsibly
  • Promptly handling follow-up matters
